1. Who we are
KindTally is operated by Karl Newton, trading as KindTally, a sole trader based in the United Kingdom ("KindTally", "we", "us", "our"). Throughout these Terms, references to "KindTally" mean Karl Newton trading as KindTally as the legal operator and seller of the service. KindTally is a family app that helps parents and guardians manage chores, pocket money, savings goals, behaviour charts and ADHD-friendly routines for their household.
By creating an account or using KindTally you agree to these Terms of Service ("Terms"). If you do not agree, please don't use the app.
2. Paddle as Merchant of Record
Our order process for paid subscriptions is conducted by our online reseller Paddle.com Market Ltd ("Paddle"). Paddle is the Merchant of Record for all paid KindTally orders. When you buy a paid KindTally plan, your purchase contract for that transaction is with Paddle, not with Karl Newton trading as KindTally.
Paddle is responsible for:
- Processing your payment and any recurring billing.
- Issuing receipts and tax invoices.
- Collecting and remitting any applicable transaction taxes (such as VAT or sales tax).
- Handling chargebacks raised through your card issuer or bank.
- Processing refund requests in line with our Refund Policy.
Karl Newton trading as KindTally remains responsible for providing the KindTally app and service itself, including product features, customer support for how the app works, account management and the day-to-day running of the service. Paddle's buyer terms are at paddle.com/legal/checkout-buyer-terms and Paddle's refund policy at paddle.com/legal/refund-policy. Nothing in these Terms is intended to conflict with Paddle's buyer terms; if there is a conflict in relation to the payment transaction itself, Paddle's buyer terms prevail for that transaction.
3. Parent and guardian account responsibility
KindTally is designed to be set up and run by an adult parent or legal guardian. You must be at least 18 years old to create a parent account. As the account holder you are responsible for:
- Keeping your sign-in details safe.
- Everything that happens on your family account.
- Making sure any co-parent or guardian you invite is someone you trust.
- Supervising your children's use of KindTally.
4. Child profiles and family data
Child profiles inside KindTally belong to your family and are controlled entirely by the parent or guardian who set up the account. Children do not create their own accounts and cannot sign up independently. Family data — chores, ledger entries, routines, behaviour notes and savings goals — is private to your family and is not shared publicly. For more detail on how we handle data, please read our Privacy Policy.
5. KindTally is not a bank or financial product
KindTally is a family organisation app. Child profiles, chore lists, pocket-money ledgers, reward charts, savings goals and allowance tracking inside KindTally are household organisation tools only. They are not, and must not be treated as:
- A bank account, e-money account, wallet or stored-value product.
- A regulated financial, investment, savings or insurance product.
- A payroll system or employment contract between parent and child.
- Financial, tax, legal or investment advice.
Pocket-money balances shown in KindTally are a record-keeping aid to help families track what is owed or earned between parent and child within their household. No real money is held, transferred, deposited or paid out by KindTally. All actual movement of money between you and your child happens outside the app and remains your responsibility.
6. Acceptable use
When using KindTally, you agree not to:
- Try to access another family's account or data.
- Use the app to bully, frighten or unfairly punish a child.
- Upload content that is illegal, abusive or harmful to children.
- Reverse engineer, scrape, resell or attempt to disrupt the service.
- Use the app in any way that breaks UK law.
We may suspend or close accounts that misuse the service, especially where a child's safety may be at risk (see also section 12 on suspension and termination).
6a. AI features (Kind Buddy)
KindTally includes an optional AI support feature called Kind Buddy. Kind Buddy is an automated assistant, not a human professional. It can be helpful for everyday encouragement, prompts and gentle reminders, but it can also make mistakes, miss context, or generate inaccurate or inappropriate responses.
Kind Buddy does not provide:
- Medical, mental-health, clinical, diagnostic or therapeutic advice.
- Safeguarding, child-protection or emergency advice — if a child is in danger, contact your local emergency services.
- Legal, financial, tax or regulated professional advice.
- A substitute for parenting judgement or professional support.
A parent or guardian remains fully responsible for reviewing how Kind Buddy is used in their household and for any decisions made on the basis of its output. You agree not to use Kind Buddy to: bully, frighten, manipulate or punish a child; generate content that is illegal, sexual, hateful, violent or otherwise harmful; attempt to extract sensitive personal data about other users; or bypass its safety guardrails.
We may moderate, rate-limit, redact or remove AI output, conversations or accounts that breach these rules or that we consider unsafe. If a Kind Buddy response worries you, please report it via /contact so we can review and improve our safeguards.
7. Free plan
KindTally offers a free plan that supports one child profile. The free plan is provided as is, may have feature limits, and may change over time. We aim to keep a meaningful free tier available, but we don't guarantee it forever.
8. Paid subscriptions
Paid plans (such as Family Plus and Family Pro ADHD) are billed in GBP on a recurring basis (monthly or yearly, depending on what you choose). Paid subscriptions are sold and processed by Paddle as Merchant of Record (see section 2). By starting a paid plan you authorise Paddle to charge your chosen payment method on each renewal date until you cancel. Prices, included features and plan names may change; we'll give reasonable notice of material changes that affect your active subscription.
9. Lifetime unlock
Where a "Lifetime" option is offered, it is a one-off payment that unlocks the included paid features for the lifetime of the KindTally service. "Lifetime" refers to the lifetime of the service, not a promise that KindTally will run forever, and it does not automatically include separate future add-on products that are sold as their own purchase. If KindTally is discontinued, no further charges will be taken and we'll give reasonable notice.
10. Cancellation and refunds
You can cancel a paid subscription at any time from your account settings or by contacting us. When you cancel, your plan stays active until the end of the billing period you've already paid for; it will not renew after that.
Because Paddle is the Merchant of Record for KindTally purchases, refunds are processed by Paddle. We offer a 30-day money-back guarantee on paid plans. Please see our Refund Policy for full details, eligibility and how to request a refund via paddle.net. Nothing in these Terms affects your statutory rights as a consumer under UK consumer law.
11. Intellectual property
Our content. KindTally — including the app, website, software, source code, design, user interface, branding, the name and logo "KindTally", written content, templates, illustrations, structure and platform features — is owned or licensed by Karl Newton trading as KindTally and is protected by UK and international intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable right to use KindTally for your family's personal, non-commercial use in line with these Terms. You must not copy, modify, resell, redistribute, reverse engineer, scrape, decompile or create derivative works from any part of KindTally without our prior written permission. You must not remove or obscure any KindTally branding, copyright notices or other proprietary markings.
Your content. You keep ownership of the family and account content you put into KindTally — such as child profile names, chore lists, ledger entries, routines, notes and photos you upload. By using KindTally you grant us a limited, worldwide, royalty-free licence to host, store, process, back up and display that content only as needed to provide the service to you and your family, keep the service secure, and comply with our legal obligations. We do not sell your family content, and we do not use it for advertising. This licence ends when you delete the content or your account, except where we need to keep limited records for legal reasons.
12. Suspension and termination
We may suspend, restrict or close your account (with or without prior notice where reasonable) if:
- You materially breach these Terms or our acceptable use rules.
- We reasonably believe the account is being used for fraud, abuse, harassment, or to put a child at risk.
- A payment for a paid plan fails and isn't resolved after reasonable attempts by Paddle to retry.
- We're required to do so by law or by a competent authority.
Where it's safe and reasonable to do so, we'll let you know and give you a chance to fix the issue first. You can also stop using KindTally and delete your family account at any time from inside the app.
13. Not medical, therapy or diagnostic advice
KindTally is a family organisation app. It is not a medical device and does not provide medical, psychological, therapeutic or diagnostic advice. Nothing in the app should be used to diagnose, treat, cure or prevent any condition. If you have concerns about your or your child's health or development, please speak to a qualified professional.
14. ADHD-friendly and routine support features
Our ADHD-friendly features — such as visual routines, one-step-at-a-time focus mode, gentle timers and break-it-down helpers — are everyday routine and organisation tools. They are designed to make daily life calmer, but they are not a substitute for medical assessment, therapy or any treatment plan from a qualified professional.
15. Availability of the service
We work hard to keep KindTally available, but we don't guarantee it will be uninterrupted, error-free or always accessible. The service may be temporarily unavailable for maintenance, updates, or due to issues outside our reasonable control.
16. Changes to the service and these Terms
We may add, change or remove features over time as KindTally grows. We may also update these Terms. If we make material changes, we'll update the "Last updated" date above and, where appropriate, let you know in the app. Continued use after changes means you accept the updated Terms.
17. Account deletion
You can delete your family account at any time from inside the app. When you delete your family, we delete the associated family data in line with our Privacy Policy. Some limited records (for example billing records held by Paddle) may be retained where the law requires.
18. Limitation of liability
KindTally is provided to help you organise family life. To the fullest extent allowed by law, we are not responsible for indirect or knock-on losses — for example lost pocket money entries, missed chores, missed routines or upset caused by using or being unable to use the app. Nothing in these Terms limits any rights you have under UK consumer law, or our responsibility for things that cannot be limited by law (such as death or personal injury caused by our negligence, or fraud).
19. Governing law
These Terms are governed by the laws of England and Wales. Disputes will be subject to the non-exclusive jurisdiction of the courts of England and Wales, without affecting any mandatory consumer protection rights you have in your country of residence.
